Sales conditions

  1. These conditions apply to all orders. Every order implies the explicit acceptance of these sales conditions.
  2. The choco-holic.be is managed by Web Retail Company. 
All prices on the e-shop include Belgian VAT.
  3. The goods are sent at both the cost and the risk of the customer to the delivery address given by the customer.
  4. If it is impossible to deliver the product, the agreement is dissolved by operation of law. The seller is obliged to notify the customer in writing before the delivery period has ended. In the case of partial delivery, each delivery will be considered a separate sale.
  5. The prices are valid at the time of publication. After this they are subject to change. The shipping costs are not included in the prices given.
  6. Given the perishable nature of our products and the current hygiene requirements, the buyer explicitly waives the right to decide against buying the product. For this reason goods cannot be sent back.
  7. Complaints or disputes should be made known within 7 days of delivery in writing and sent by registered post under penalty of cancellation. If the complaint is found to be grounded, our liability is limited to the replacement of the goods. Any liability on the part of the seller limits itself to the actual amount paid for the order.
  8. In the event of overdue payments, interest shall be added to the outstanding amounts on the invoice by order of law and without prior notice of default at a rate of 1% per months as of the invoice date. In case of non-payment and if a demand by ordinary post is not responded to within 14 days, fixed compensation to the value of 10% of the outstanding amount with a minimum of 50 € and a maximum of 2,000 € will be due.
  9. The seller remains owner of all goods until full payment has been made.
  10. The seller is not liable for the advice he gives, printing errors on the website or technical data given by the producer or delivery company.
  11. Belgian Law applies to these conditions of sale and any disputes will be referred to the competent district court of Bruges.
  12. Web Retail Company is not responsible for any foreign customs fees or duties that may be applied after shipment.
  13. Web Retail Company does its utmost to ensure that all pricing information on the e-shop is accurate, but cannot guarantee the absolute absence of error. In the event that an error in the price of a product shall occur, Web Retail Company will allow customers the option to confirm the purchase of the Product at the correct price or to cancel the order. If the customer is unable to contact us within 30 days, the order will be treated as canceled.
  14. The order will be dispatched between between Monday and Friday, excluding local and national holidays and festivities. Web Retail Company is not responsible for unforeseen delays. Web Retail Company is not responsible for unpredictable delays, notwithstanding that, except for cases of Force Majeure, the Product(s) will be delivered within a maximum of thirty (30) days following the day after the submission to Web Retail Company of the order by the Customer. Unless other specified by the wait time specified on the order.
  15. In the event that, due to sudden and temporary unavailability of products, Web Retail Company shall be able to delivery the goods, Web Retail Company shall promptly inform the Customer, and in any way within thirty (30) days via e-mail. 
The products can be returned within 14 days after receiving the order. The articles can’t be returned or refunded in a regular choco-holic.be store.
  16. Web Retail Company recommends using a courier when returning goods in order to allow the tracking of the shipment. Web Retail Company will not be held responsible for the refund or the compensation of those products that have been lost, stolen or damaged.
  17. Web Retail Company uses it’s best endeavors in order to keep the information on the e-shop constantly updated. Web Retail Company can’t guarantee the complete absence of errors on the e-shop. The shop may contain typographical errors, mistakes and inaccuracies relating to the price, availability or details of products.
  18. Web Retail Company reserves the right to amend the errors or inaccuracies, even after an order has been submitted and furthermore reserves the right to amend or modify the information on the e-shop at any time without any prior communication.
